2. Eligibility to Use the Website
You must be at least 18 years old and legally capable of entering into a binding contract to place an order through this website.
By using the website or placing an order, you represent that:
- The information you provide is accurate and complete.
- You are authorized to use the selected payment method.
- You are purchasing for a lawful purpose.
- Your purchase and intended use comply with applicable laws.
- You have authority to act for any business or organization identified in the order.
National Engine Depot may request identity, payment, address or business verification before accepting or shipping an order.
3. Products We Sell
National Engine Depot supplies automotive and industrial products that may include:
- New and remanufactured engines
- Crate engines
- Automatic and manual transmissions
- Differentials
- Transfer cases
- Drivetrain components
- Horizontal and vertical engines
- Installation components
- Related automotive and industrial parts
The condition of each product—such as new, remanufactured, refurbished or used—will be identified on the applicable product page, quotation or order confirmation.
A remanufactured product is not a brand-new product. It has been professionally restored, inspected or rebuilt according to the process described in the applicable product listing or warranty documentation.
4. Product Information and Images
National Engine Depot makes reasonable efforts to ensure that product titles, descriptions, specifications, part numbers, images, condition, prices and availability are accurate.
Product images are intended to accurately represent the advertised product. Minor non-material differences may occur in packaging, labeling, finish or manufacturer revisions that do not change the product’s identity, fitment or essential specifications.
National Engine Depot will not knowingly substitute a materially different product without notifying the customer and obtaining approval.
If we discover a material error in a product listing before shipment, we will contact the customer with the corrected information. The customer may approve the correction or cancel the affected unshipped item for a full refund.
5. Product Compatibility and Customer Responsibility
Automotive engines, transmissions and drivetrain components may have application-specific requirements. Products that appear similar may not be interchangeable.
Before ordering, customers are responsible for providing and verifying all applicable information, including:
- Vehicle year
- Vehicle make and model
- Vehicle Identification Number
- Engine code
- Transmission code
- Emissions configuration
- Casting number
- Drivetrain configuration
- Product dimensions
- Intended application
- Required accessories and installation components
National Engine Depot may provide compatibility assistance based on information supplied by the customer. Such assistance does not replace inspection or verification by a qualified installer.
The customer is responsible for reviewing the final product description, part number, condition and application before completing the purchase.
Returns caused by inaccurate or incomplete information supplied by the customer are governed by our Returns and Refund Policy and may be subject to return freight and a restocking fee.
6. Quotations
A quotation is valid only for the period stated in the quotation. If no validity period is specified, the quotation remains valid for seven calendar days unless withdrawn earlier due to an error or material change in supplier availability.
Unless expressly stated otherwise, quotations:
- Are issued in United States Dollars
- Apply only to the customer and products identified
- Do not include taxes, duties or additional services not listed
- Are subject to product availability
- Do not reserve inventory until the stated payment or deposit has been received and verified
If a signed quotation, commercial invoice or written sales agreement contains product-specific terms that conflict with these general Terms and Conditions, the product-specific written terms will control for that transaction.
7. Prices, Taxes and Charges
All website prices are displayed in United States Dollars unless another currency is clearly stated.
The product price displayed on the product page should match the price charged during checkout, excluding separately disclosed:
- Sales tax
- Shipping or freight
- Optional services
- Government-imposed fees
- Customs duties and import charges
Mandatory merchant-imposed charges will be disclosed before the customer completes the order.
Customers are responsible for applicable sales, use, customs, import and similar taxes unless National Engine Depot is legally required to collect and remit them.
Promotional pricing applies only during the stated promotion period and while qualifying inventory remains available.
8. Availability and Inventory
Availability displayed on the website is based on inventory and supplier information reasonably available to National Engine Depot.
Products identified as in stock should be available for purchase and fulfilment within the stated handling period. Products awaiting inventory or supplier fulfilment will be identified as backordered, available for preorder, special order or otherwise unavailable, as applicable.
Inventory may be held at a National Engine Depot facility, manufacturer facility, remanufacturing facility or approved supplier warehouse.
If inventory becomes unavailable after an order is submitted, National Engine Depot will notify the customer. We may offer:
- A revised shipment date
- An equivalent alternative product, subject to customer approval
- Cancellation of the affected item and a full refund
National Engine Depot will not substitute another product or charge a higher price without the customer’s express approval.
9. Order Submission and Acceptance
Submitting an order constitutes an offer to purchase the selected products under these Terms and Conditions.
An automated order acknowledgment confirms that the order was received but does not constitute final acceptance. An order is accepted when National Engine Depot sends written acceptance, confirms allocation or ships the product, whichever occurs first.
National Engine Depot may refuse or cancel an order before acceptance for legitimate reasons, including:
- Product unavailability
- A material pricing or listing error
- Payment failure
- Suspected fraud or unauthorized payment
- Incomplete or inaccurate customer information
- Export, legal or regulatory restrictions
- Inability to deliver to the supplied address
- Quantity limitations
- Suspected resale or use that violates applicable law
If we cancel a paid order, we will notify the customer and refund the amount paid for the cancelled items.
10. Pricing and Listing Errors
Although we take reasonable measures to maintain accurate listings, typographical, technical or data-entry errors may occur.
If a material pricing or product-information error is discovered before shipment, National Engine Depot will:
- Notify the customer;
- Provide the corrected information; and
- Allow the customer to approve the correction or cancel the affected item for a full refund.
We will not charge a corrected higher price or provide a materially different product without the customer’s express consent.
11. Payment
Full payment must be received and verified before shipment unless different payment terms are agreed to in writing.
Accepted payment methods may include:
- Credit cards
- Debit cards
- Bank transfers
- Approved third-party financing
- Other methods displayed during checkout
National Engine Depot does not offer cash-on-delivery service unless expressly confirmed in writing.
Orders paid by bank transfer will not be released until the funds have cleared and payment has been verified.
Customers are responsible for bank, currency-conversion or intermediary charges imposed by their financial institutions.
National Engine Depot may use third-party payment processors and fraud-prevention services. We do not store complete payment-card information when payments are processed by an independent payment provider.
12. Financing
Financing is provided by independent third-party financing companies and is subject to their eligibility requirements, credit decisions, interest rates and separate agreements.
National Engine Depot does not guarantee financing approval.
Financing advertisements, estimated payments or promotional rates do not constitute approval or a lending offer from National Engine Depot. Customers should review all lender disclosures before accepting financing.
13. Order Cancellations
Cancellation requests should be submitted as soon as possible.
A standard stocked-product order may be cancelled for a full refund if:
- The order has not shipped;
- Freight has not been booked or collected; and
- The order has not been released for manufacturer, supplier or custom fulfilment.
Custom-built, made-to-order and specially procured products may become non-cancellable after production, procurement or supplier fulfilment begins, provided that restriction was disclosed before purchase.
If the order has already shipped, cancellation will be handled as a return under the Returns and Refund Policy.
14. Shipping and Delivery
Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms and Conditions.
Handling and delivery estimates are based on the product, destination, carrier availability and information available when the order is accepted.
National Engine Depot will have a reasonable basis for any advertised shipment estimate. If we cannot ship within the promised period, we will notify the customer and, where required, provide the option to:
- Accept a revised shipment date; or
- Cancel the affected unshipped product for a full refund.
When no shipping time is stated, the order will be shipped within the period required by applicable law.
Delivery estimates provided by freight carriers are estimates and may be affected by weather, carrier capacity, address access, customs or other circumstances outside our reasonable control.
15. Freight Deliveries
Engines, transmissions, differentials and other oversized products may be delivered by a freight carrier.
The customer is responsible for:
- Providing an accurate delivery address and telephone number
- Identifying whether the address is residential or commercial
- Disclosing limited-access requirements
- Confirming whether liftgate service is required
- Being available for the scheduled delivery
- Inspecting the shipment before signing the delivery receipt
Visible damage or missing packages must be recorded on the carrier’s delivery receipt. Customers should photograph the product, pallet and packaging and contact National Engine Depot promptly.
Failure to document visible freight damage may limit the available carrier claim but does not eliminate rights that cannot legally be waived.
16. Title and Risk of Loss
For domestic orders, risk of loss transfers to the customer upon confirmed delivery to the customer or authorized recipient.
Ownership transfers after National Engine Depot has received full payment and the product has been delivered, except where applicable law requires otherwise.
For international shipments, title, risk and delivery responsibilities will be governed by the shipping terms stated in the applicable quotation or invoice.
17. Returns and Refunds
Returns, exchanges, refused deliveries and refunds are governed by our Returns and Refund Policy, which is incorporated into these Terms and Conditions.
All returns require:
- Prior approval
- A valid Return Merchandise Authorization number
- Compliance with the applicable return window
- Compliance with packaging and condition requirements
National Engine Depot may inspect returned merchandise before approving a refund.
Products that have been installed, used, modified or damaged after delivery may not qualify for a standard return. Defective installed products may be handled under the applicable warranty.
Nothing in these Terms limits non-waivable rights under applicable law.
18. Core Charges and Core Returns
Certain products are sold with a refundable core charge.
Core returns are governed by the applicable product terms and our Core Return Policy.
To qualify for core credit, a returned core generally must:
- Be substantially complete
- Be rebuildable
- Be drained of fluids
- Include required major components
- Be properly packaged
- Be returned within the stated period
- Pass inspection
Core credit is not guaranteed until the core has been received and accepted.
Missing, cracked, incomplete, non-rebuildable or improperly packaged cores may receive reduced credit or be rejected in accordance with the disclosed Core Return Policy.
19. Product Warranties
Warranty coverage is governed by the warranty accompanying the applicable product and our published Warranty Policy.
Warranty coverage may vary according to:
- Product condition
- Manufacturer
- Product category
- Warranty plan selected
- Intended application
- Installation requirements
- Geographic location
- Maintenance and registration requirements
Customers must review all applicable warranty terms before installation.
Warranty claims may require professional diagnostic records, installation invoices, maintenance records, photographs, serial numbers and prior authorization.
A warranty remedy may include diagnosis, repair, replacement or another remedy stated in the applicable warranty. Warranty coverage does not automatically entitle the customer to a refund.
Nothing in these Terms excludes an express or implied warranty that cannot legally be disclaimed.
20. Installation Requirements
Engines, transmissions and drivetrain components require specialized knowledge and proper installation.
Unless product documentation expressly permits otherwise, installation should be completed by a qualified professional using appropriate tools and procedures.
Before installation, the customer and installer must:
- Confirm the product and application
- Inspect the product for visible damage
- Verify all identification and casting numbers
- Diagnose the cause of the original component failure
- Correct related cooling, lubrication, electrical or fuel-system problems
- Follow manufacturer installation and break-in instructions
- Replace required supporting components and fluids
- Retain installation and maintenance documentation
Improper installation, overheating, insufficient lubrication, contamination, misuse, unauthorized modification or failure to correct related vehicle problems may affect warranty coverage.
21. Legal and Regulatory Compliance
The customer is responsible for determining whether a product is lawful and suitable for the intended application and location.
Some products may be restricted for:
- On-road use
- Emissions-controlled vehicles
- Racing or competition
- Marine or stationary applications
- Commercial vehicles
- Export destinations
National Engine Depot does not authorize customers to remove, bypass or disable legally required emissions or safety equipment.
Any application restriction disclosed on the product page, quotation, warranty or product documentation must be followed.
22. International Orders
International customers are responsible for:
- Customs clearance
- Import permits
- Duties and taxes
- Brokerage charges
- Destination-country compliance
- Product-registration requirements
- International core returns
- Return and warranty freight unless otherwise agreed
International orders may be delayed, restricted or rejected by customs or regulatory authorities.
National Engine Depot is not responsible for customs actions caused by the customer’s failure to obtain required permits or comply with destination-country laws. This does not limit responsibility for documents or obligations that National Engine Depot expressly agrees to provide.
Products may not be exported, re-exported or transferred in violation of United States export controls, sanctions or other applicable laws.
23. Customer Accounts
Customers are responsible for maintaining the confidentiality of their account credentials and restricting access to their devices.
You must notify National Engine Depot promptly if you believe that:
- Your account has been accessed without authorization;
- Your password has been compromised; or
- An unauthorized order has been submitted.
National Engine Depot may suspend an account when reasonably necessary to investigate suspected fraud, security incidents or violations of these Terms.
24. Acceptable Website Use
Users may not:
- Use the website for unlawful or fraudulent purposes
- Submit false or misleading information
- Attempt unauthorized access to accounts or systems
- Introduce malware or harmful code
- Interfere with website security or functionality
- Scrape or extract website data through unauthorized automated means
- Impersonate another person or business
- Use website content to create misleading listings

National Engine Depot may restrict access when these requirements are violated.
25. Intellectual Property
Unless otherwise stated, website text, graphics, logos, design elements and original content are owned by or licensed to National Engine Depot and are protected by applicable intellectual-property laws.
Manufacturer names, product names, photographs, trademarks and logos remain the property of their respective owners.
Reference to a manufacturer or trademark identifies the advertised product or compatibility and does not by itself mean that National Engine Depot is the manufacturer or an authorized dealer.
No claim of manufacturer authorization is made unless expressly stated and supported.
Website content may not be reproduced, republished, modified or distributed for commercial purposes without written permission from the applicable rights holder.
26. Reviews and Customer Submissions
Customers may submit genuine reviews, questions, photographs or other content based on their own experience.
Submitted content must not:
- Be false, misleading or fraudulent
- Describe an unrelated business or transaction
- Infringe another person’s rights
- Contain unlawful, abusive or confidential information
- Include malware or unauthorized advertising
By submitting content, you grant National Engine Depot a non-exclusive, royalty-free license to display and use that content in connection with our business, subject to applicable privacy and consumer-protection laws.
National Engine Depot may moderate or remove content that violates these requirements but will not alter reviews in a manner that misrepresents the customer’s opinion.
27. Third-Party Websites and Services
The website may contain links to manufacturers, financing providers, payment processors, carriers or other third parties.
National Engine Depot does not control independent third-party websites and is not responsible for their content, security or privacy practices.
A third-party link does not constitute an endorsement or partnership unless expressly stated.
Customers should review the terms and privacy policies of any third-party service they use.
28. Website Availability
We attempt to keep the website secure and operational but do not guarantee uninterrupted or error-free access.
National Engine Depot may temporarily restrict website access for maintenance, security, upgrades or circumstances outside our reasonable control.
Website interruptions do not alter accepted orders or customer rights.
29. Disclaimer of Website Warranties
To the extent permitted by law, the website and its general informational content are provided on an “as available” basis.
National Engine Depot does not guarantee that the website will always be uninterrupted, error-free or free from harmful components.
This website disclaimer does not replace, reduce or modify an express product warranty or any warranty that cannot legally be excluded.
30. Limitation of Liability
To the fullest extent permitted by applicable law, National Engine Depot will not be liable for indirect, incidental, special or consequential losses resulting from use of the website or a product, including:
- Loss of use
- Vehicle downtime
- Lost profits
- Lost business
- Rental vehicle expenses
- Towing expenses
- Unauthorized labor or repair expenses
This limitation does not apply to:
- Amounts expressly covered by an applicable written warranty
- Liability caused by fraud or intentional misconduct
- Personal injury or property damage where liability cannot legally be limited
- Rights and remedies that cannot legally be waived
Subject to these exceptions, National Engine Depot’s aggregate liability arising from a product transaction will not exceed the amount paid for the product giving rise to the claim.
31. Force Majeure
National Engine Depot will not be responsible for delay caused by circumstances beyond its reasonable control, including severe weather, natural disasters, fire, labor interruption, war, terrorism, civil unrest, government action, carrier interruption, cyberattack or widespread supply-chain disruption.
This provision does not eliminate the customer’s right to cancel and receive a refund when required by applicable fulfilment laws.
32. Privacy
Personal information is handled according to our Privacy Policy, which is incorporated into these Terms and Conditions.
By using the website, you acknowledge the collection and handling of information as described in that policy.
33. Electronic Communications
By submitting an order or contacting National Engine Depot electronically, you consent to receive transactional communications relating to quotations, orders, payments, delivery, returns, warranty claims and customer service.
Marketing communications will be sent in accordance with applicable consent requirements. Customers may unsubscribe from marketing emails without affecting necessary order or service communications.
34. Governing Law and Venue
These Terms and Conditions and transactions with National Engine Depot are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles.
To the extent legally permitted, disputes that cannot be resolved informally will be brought in a state or federal court having jurisdiction in Alameda County, California.
Nothing in this section limits a consumer’s right to bring a claim in another forum where that right cannot legally be waived.
35. Severability
If any provision of these Terms and Conditions is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted or removed to the minimum extent necessary.
The remaining provisions will continue in effect.
36. No Waiver
Failure by National Engine Depot to enforce any provision does not waive the right to enforce that provision later.
A waiver is effective only when made in writing by an authorized representative.
37. Assignment
Customers may not assign their rights or obligations under a product order without written approval from National Engine Depot.
National Engine Depot may assign its rights and obligations as part of a merger, reorganization, sale of assets or similar business transaction, subject to applicable law.
38. Entire Agreement
These Terms and Conditions, together with the applicable product page, accepted quotation, order confirmation, Shipping Policy, Returns and Refund Policy, Core Return Policy, Warranty Policy and Privacy Policy, constitute the agreement between the customer and National Engine Depot concerning the transaction.
Product-specific written terms will control over these general terms when they directly conflict.
39. Changes to These Terms
National Engine Depot may update these Terms and Conditions to reflect operational, legal or regulatory changes.
Revisions become effective when published and will display an updated revision date.
Changes will not retroactively alter an order already accepted unless required by law or agreed to by the customer.
